These Terms and Conditions (“Terms”) govern the relationship between you (“Client,” “you,” “your”) and Jeff Alagar Fitness (“Coach Jeff,” “we,” “our,” “us”). By purchasing, enrolling in, or participating in any of our fitness coaching services, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Scope of Services
- Jeff Alagar Fitness provides personalized online fitness coaching, including workout programming, nutrition guidance, and accountability support through digital platforms such as My PT Hub, WhatsApp and other communication channels.
- Services may include—but are not limited to—exercise programming, nutrition targets, check-ins, progress tracking, educational resources, and client support.
- While we commit to providing professional and science-based guidance, we do not guarantee specific outcomes, as success depends on your adherence, effort, and individual circumstances.
2. Client Eligibility & Health Responsibility
- By enrolling, you confirm you are at least 18 years old.
- You represent that you are in good physical health and have either:
- Received clearance from your physician before beginning a new fitness or nutrition program; OR
- Chosen to participate at your own risk.
- You acknowledge that participation in exercise and nutrition programs carries inherent risks, including injury or adverse health events. You agree to assume all risks associated with your participation.
3. Payments & Refund Policy
3.1 General Terms
- Payment for coaching services must be made in full or according to an agreed-upon installment schedule before program access is granted.
- All prices are listed in Philippine Peso (PHP) unless otherwise specified.
3.2 Refund Policy
- Partial payments are strictly NON-REFUNDABLE.
- Full payments may be refunded partially only under a mutual agreement between the client and Coach Jeff.
- Refunds, if granted, will be based on services already delivered, such as completed weeks of coaching, prepared meal plans, or workout programs.
- Subscription-based fees, installment payments, and promotional packages are final and non-refundable.
3.3 Onboarding Form & Program Initiation
- The completion and submission of the official onboarding form signifies that your program is FINAL and INITIATED.
- Once initiated, you are fully enrolled, and the above refund policies apply in full.
- From this point forward, you are considered an active client, and resources (including app setup, programming, and client support time) will be allocated to you.
4. Client Commitments
By enrolling in Jeff Alagar Fitness, you agree to:
- Provide truthful, complete, and up-to-date personal, health, and lifestyle information during onboarding.
- Follow prescribed workouts, meal plans, and coaching instructions to the best of your ability.
- Perform exercises safely, using proper form and appropriate weights.
- Immediately stop any exercise causing pain, discomfort, or injury and seek medical attention if necessary.
- Communicate openly with Coach Jeff regarding challenges, injuries, or changes in your schedule or health.
- Log workouts, nutrition, and progress updates consistently on the assigned platforms (e.g., My PT Hub).
Failure to uphold these commitments may impact your results, and Jeff Alagar Fitness will not be held responsible for lack of progress due to non-compliance.
5. Program Access & Duration
- Access to programs, coaching app features, and communication with Coach Jeff will be provided for the duration of your chosen package.
- Upon program completion or termination, access to the coaching app and related resources will be revoked unless the program is renewed or extended.
- Programs cannot be paused, transferred, or extended without written agreement.
6. Cancellation & Termination
- Clients may request program cancellation in writing, but refunds will only be considered in line with Section 3.
- Jeff Alagar Fitness reserves the right to terminate coaching services immediately in cases of:
- Abusive or disrespectful behavior toward Coach Jeff or team members
- Breach of these Terms
- Misuse or unauthorized sharing of intellectual property
- In such cases, no refunds will be issued.
7. Liability Waiver
- You understand and acknowledge that participation in exercise programs involves risk of injury or health complications.
- By enrolling, you agree to release, indemnify, and hold harmless Jeff Alagar Fitness, Coach Jeff, and all affiliates from any liability for injuries, damages, or losses that may result from your participation.
- You are solely responsible for ensuring your physical readiness and ability to participate in fitness and nutrition programs.
8. Intellectual Property
- All coaching materials—including workout programs, nutrition plans, guides, educational resources, templates, and digital content—are the sole property of Jeff Alagar Fitness.
- These materials are for personal use only. You may not reproduce, distribute, resell, or share them without written consent from Coach Jeff.
9. Confidentiality & Data Protection
- All personal, health, and progress information you provide will remain confidential and will not be shared with third parties without your consent, except when required by law.
- Data will be handled in compliance with applicable privacy and data protection laws.
10. No Guarantees
- While we provide expert guidance and support, we cannot guarantee specific results such as weight loss, muscle gain, or performance improvements.
- Results vary depending on effort, adherence, health conditions, and other personal factors.
11. Amendments
- We reserve the right to update or revise these Terms and Conditions at any time.
- Clients will be notified of significant changes. Continued use of our services after updates constitutes acceptance of the revised Terms.
12. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
- Any disputes arising shall be subject to the jurisdiction of the appropriate courts in the Philippines.
